The Australian Government has published a series of changes to Family Stream Visas in June. All the changes take effect today, July 1, 2011.



From 1 July, the Australian Government make many amendments to the Migration Regulations 1994 (the Regulations) involving in Family Visa Category. The majority of these changes relate to stricter requirements to apply for Partner visas (Residence Class BS) as follows:



  • It is impossible for an applicant who has failed to get a partner category visa in the last 21 days and currently holds a Partner visa (subclass 820 and 309) to make a valid application under Partner (Residence) visa (Class BS, subclass 801).


  • To apply for a Partner visa (Residence Class BS):




    • non-citizens who leave and come back to the migration zone while holding a Bridging visa are required to stay continuously in the migration zone despite the travel.


    • applicants affected by section 48 of the Migration Act 1958 must meet the requirements that currently apply to the Partner visa (Temporary Class UK), and they also have to present their two statutory declarations relating to their partner relationship maximum of 6 weeks before their visa applications were made.






The amendments also include an additional primary criterion to for the grant of a Subclass 115 – Remaining Relative visa and a Subclass 116 – Carer visa. Accordingly, applicants who are under the age of 18 must satisfy public interest criteria 4017 and 4018.

The Australian also announces the limit amount of Parent, Contributory Parent and Other Family Visas to be granted in 2011-2012 Fiscal Year. The maximum amount for Aged Parent visas (Class BP, Subclass 804) and Parent visas (Class AX, Subclass 103) is 2010; for Contributory Parent visas (Class UT, Subclass 173), Contributory Parent visas (Class CA, Subclass 143), Contributory Aged Parent (Class DG, Subclass 864), and Contributory Aged Parent (Class UU, Subclass 884): 7400; for other Family visas (Class BO Migrant), and Other Family visas (Class BU Residence): 1290.
