Migration Regulations 1994 ("the Regulations") have been amended to remove the discretionary "Assurance of Support" (AoS) requirements from certain Partner visas, the Australian Department of Immigration and Citizenship has recently announced.
The AoS scheme allows welfare costs for certain migrants to be met by an Australian permanent resident or citizen, rather than the Australian community. An AoS is a legal commitment by a person (the assurer) to provide financial support to an Australian visa applicant so that they will not have to rely on social welfare payments. Under current Australian immigration rules, some visa applicants need to provide an Assurance of Support (AoS) before their visa application can be granted.
The discretionary AoS requirement is now removed from Australian Partner visas. The amendment took effect from January 1, 2012. This means that an AoS will not be required for Partner visa applications made on or after January 1, 2012. The change also applies to visa applications under Partner visa category which were made but not finally determined before January 1, 2011.
The change follows the amendments to the Social Security Act 1991 which align access to Special Benefit for temporary Partner visa holders with that of permanent visa holders. This makes the discretionary AoS requirement become redundant for these visas.
This change affects the following visa subclasses:
- Partner temporary visa (subclass 309)
- Partner permanent visa (subclass 100)
- Partner temporary visa (subclass 820)
- Partner permanent visa (subclass 801)
- Prospective Marriage visa (subclass 300)
