The Honorable Vic Toews, Canada's Minister of Public Safety, and the Honorable Jason Kenney, Minister of Citizenship, Immigration and Multiculturalism have together re-introduced controversial legislation in Parliament to tackle human smugglers.
According to Mr Toews, although thousands of immigrants as well as refugees are welcomed to enter Canada through one of the most generous and fair refugee systems in the world, this source of pride for Canada has come under attack from human smuggling networks.
"By re-introducing this legislation we are sending a clear message that our doors are open to those who play by the rules - including all legitimate refugees. However, we will crack down on those who endanger human lives and threaten the integrity of our borders," said Minister Kenney.
The proposal "Preventing Human Smugglers from Abusing Canada's Immigration System Act" which was first announced in October 2010 has now been re-introduced with many new measures to crack down on human smugglers.
The legislation raises penalties for those doing the smuggling and introduces minimum sentences from 3 to 10 years depending on how dangerous the passage was, the money involved, and how many people were smuggled.
The legislation also makes ship owners and operators liable for use of their ships in human smuggling; establishes mandatory detention of irregular mass arrivals to allow for illegal arrivals to be detained while their details are investigated. It prevents migrants involved in a smuggling operation from applying for permanent residency or sponsoring family members to immigrate to Canada for five years.
