The Texas House passed a bill that would allow Texas counties to take into consideration the income of a legal immigrant's sponsor when deciding if the immigrant is eligible for indigent health care this Monday.
The Texas legislature has recently sent to the governor a measure requiring legal U.S. permanent residents to provide additional proof they are impoverished before qualifying for state indigent care services. Senate Bill 420, by state Sen. Bob Deuell, R-Greenville, allows individual counties to check the financial resources of the U.S. citizen who sponsored a permanent resident's entry into the U.S. before allowing the Green card holder access to indigent care services. If the sponsor has the resources to finance treatment, the person they sponsored wouldn't be eligible for this benefit. The bill also would allow counties to take the income of a sponsor's spouse into account when the applicant requests indigent care. It passed the Senate last month and passed in the House this Monday.
The proposed legislation has been strongly criticized by opponents who believe it is really an attempt to use the current fervor over illegal immigration to punish those who have legally migrated to Texas."We've had a lot of bills [filed] that really try to attack a large segment of our population," said state Rep. Armando Walle, D-Houston, one of 37 Democrats to vote against the measure.
However, state Rep. Van Taylor, R-Plano, the House sponsor, said the bill largely restates existing federal law, and pointed to language on U.S. immigration forms, like the I-134. It requires that a sponsor agree to language that the alien "will not become a public charge in the United States." The form also includes language specifically stating that the sponsor's own income "and assets may be considered in deciding the person's application."
