Attorneys representing the state of Georgia have requested an appeals court overturn the judge's decision blocking several parts of the state's new immigration law.
According to Lauren Kane, a spokeswoman for the state Attorney General's Office, an appeal would be filed with the 11th Circuit Court of Appeals in the coming days. This was marked last week with the preliminary injunction by U.S. District Judge Thomas Thrash Jr. which blocked some key provisions of the US immigration law.
This controversial legislation contains sections relating to the additional methods needed to prevent illegal immigration in the US. They would allow police to consider the US immigration status when questioning suspected migrants in certain criminal investigations. They also would punish people who, during the commission of a crime, knowingly transport or harbor illegal immigrants such as speeding or driving without proper equipment.
Plaintiffs in the class-action suit against the law have argued that it is unconstitutional and this legislation would create "such a climate of hostility, fear, mistrust and insecurity that all illegal aliens will leave Georgia", Thrash wrote in his ruling.
However state officials have contended that the HB 87 provisions in the new law are necessary steps to protect state resources.
This Georgia lawsuit is now the latest battle in a nationwide skirmish between state and federal officials for control over the US immigration enforcement.
