The USCIS granted the sheepherding industry a one-time accommodation grant, giving the industry more time to fully transition to the three-year limitation-of-stay requirements for the H-2A visa category, which took effect from January 17, 2009.
Under the rule, all H-2A nonimmigrant workers, including sheepherders, are subject to a three-month
departure requirement once they have been in the United States in H-2A status for the maximum three-year period. That means if H-2A visa holders have been in the U.S. for three years, they must depart and remain outside the country for at least three months before being granted an H-2A visa again. The expiration of the grant means that any H-2A sheepherders present in the U.S. on January 17, 2009, must depart the U.S by January 16, 2012.
An H-2A visa is a temporary work visa for foreign agricultural workers with a job offer for seasonal agricultural work in the U.S.
