After several months, the US Embassy has recently cancelled a suspension on IBM and Tata Consultancy Services (TCS) from participating in the Business Executive Program (BEP) which allows them to expedite temporary work visas for their employees. Both companies, along with three others, were suspended in 2010 on grounds of irregularities.
BEP is designed to facilitate frequent and legitimate business travel to the U.S. and make it efficient. BEP exists because the U.S. Government welcomes trade and commerce between the U.S and India, and it wants to accommodate legitimate business travelers with a minimum of delay and inconvenience.
Being a member of BEP can bring some advantages for employers to expedite the U.S. temporary work visa process for their employees. However, being an employee of a BEP participant company does not guarantee a U.S visa, every applicant must qualify on his/her own for it.
U.S. consular in India also has a Business Executive Program with around 350 members, which provides services to qualified businesses. Last year, five large employers, including IBM and TCS were suspended from the program as a result of the fraud discovered in visa applications filed by purported employees. After a few months' suspension, IBM and TCS have recently been reinstated in the program.
The status of two other suspended firms - Cognizant and HCL Technologies - could not be ascertained. Applications from individuals claiming to work in the U.S. for those employers now receive particularly close scrutiny, said a US Consular official.
While visa fraud issues are being highlighted on a regular basis, the actual number of H1-B visa applications has been falling. According to reports, H-1B enrollments have dropped 50 per cent over the same time last year, and by 80 per cent since 2009. US Citizenship and Immigration Services recently reported that it only received approximately 8,000 H-1B petitions in April, compared with 16,500 in April 2010 and 45,000 in April 2009.
