U.S. immigration reform has been a federal topic since the signing of the constitution. Recognizing several problems in the U.S. H-2A program, Utah's government has adopted its own system focusing on integrating immigrants into society.
Utah signed House Bill 116 into law in March, which seeks to tighten enforcement against undocumented migrants while also recognizing that some businesses in the state depend on immigrant labor. Republican State Representative Bill Wright was responsible for introducing the legislation.
The regional immigration reform policy created a guest worker act for current migrant workers in Utah as "we decided that maybe we could solve some of the issues ourselves", expressed Wright.
In its early stages, HB 116 aimed to provide U.S. working permits to guest workers so that the government could clarify the number of undocumented immigrants living in Utah. HB 116 gained traction and ultimately received bipartisan support before it came into effect in March. Currently, the program allows Utah not only to identify all workers and but also provide them with basic employee rights through their own immigration system.
Immigrants who want to work in the U.S. under Utah's existing guest working permit need to meet the following requirements:
- be employed in the state for a certain amount of time;
- pass a background check;
- have no outstanding debt and be proficient in or learning English.
Immigrants would have to pay $2,500 for permits or pay $1,000 for overstaying a visa in the U.S. and would be allowed to bring their families to the U.S. with them.
Although foreign workers would need to renew their guest working permit on a biennial basis, Wright ensures that the permit in no way ties them to their current job.
"You have freedom to move between jobs," he says. "You have the opportunity to live within the state, be able to work and make a living and be a good citizen. This is making our communities better."
At this time, the program doesn't provide immigrant workers with pathway to U.S. citizenship or naturalization but Wright believes that step is probable.
Wright hopes that other states will follow in Utah's footsteps so that the federal government will take notice.
"We're moving forward and we're hoping that other states and other associations might join us in being able to implement," he says. "It's going to take a coalition of states and individuals to better our society. When we get a critical mass, you'll see Congress start to take action."
